  1. License. STM assets cannot be used for other purposes. The customer is granted a limited license to use generic website assets, such as photos, graphics or fonts, provided by StyleTrain Media (STM). This means that the website assets can be used in the website for as long as the website remains active, but cannot be used for any other purposes, such as other websites or printed materials. This includes assets supplied by STM as part of a website template, but does not include assets supplied by the customer or any custom photos, graphics, drawings or logo’s provided by STM for an additional charge.

  2. Fees. 50% upfront plus 50% to go live. The customer is to sign to the order form agreeing to the website design elements and optional components. The customer will then be invoiced for the total amount. A Fifty percent deposit must be paid before work on the website is commenced by STM. This deposit is non-refundable. The balance will become due when the final design is approved by the customer. The website will be published on the live internet web server once the final payment has been made.

  3. Hosting. Yearly fee required to stay live. The Web Presence package includes 12 months web server hosting. At the end of the twelve month period from when the website goes live a yearly renewal fee is due. STM will invoice the customer for the yearly renewal fees which must be paid within thirty days of the invoice date. If the invoice is not paid within thirty days STM will remove the website from the server. Extra fees may apply to reload a website on to the web server if it has been removed.

  4. Domain Name. Yearly fee to stay live. The Web Presence package includes the registration of a .com.au domain name for twelve months. The yearly renewal fee includes re-registration of the domain name for a further 12 months. STM will invoice the customer for the yearly renewal fees which must be paid within thirty days of the invoice date. If the invoice is not paid within thirty days the domain registration will lapse. STM cannot guarantee that the domain name will remain available as it can then be registered by another business.

  5. Approval. One set of corrections. As part of the Web Presence package the customer will be presented with a sample of the website for approval. The customer may request changes to the design or content at this time. One set of corrections are included in the package price. Any further changes are chargeable to the customer at a rate of $90 per hour. Corrections to the website do not include a change of template.

  6. Delivery. Deadlines not guaranteed. The STM representative will give an estimated delivery time for the website. The delivery time will be affected by both the current workload of STM and by the supply of any website assets by the customer to STM. Therefore while STM will endeavour to deliver the website promptly, STM will not guarantee the delivery time of the website and has no liability for any losses caused by late delivery.

  7. Viewing. Websites can look different on different computers. The nature of websites being viewed on various types of computers and web browsers means that differences in the display of colours, fonts and layouts may occur. While STM will always endeavour to follow WC3 standards for web design, STM cannot guarantee the appearance of the website in all browsers.

  8. Reliability. There may be some outages. STM websites are hosted on high quality servers and 99.99% uptime is expected. However due to the nature of computers some outages may occur from time to time. STM will accept no liability for any losses incurred by any technical faults.

  9. Bandwidth. 5GB limit on website traffic. The Web Presence package includes 5GB of bandwidth per month. If the traffic to a website exceeds 5GB per month then additional fees of $5 per 1GB will be charged. If website traffic is expected to exceed the 5GB limit on a regular basis then the package can be upgraded at any time.

  10. Storage. 500MB limit on server disk space. The Web Presence package includes 500MB of disk space on the hosting server for the website and email accounts. If the disk space used exceeds 500MB then additional fees of $5 per 100MB will be charged. If the disk space used is expected to exceed the 500MB limit on a regular basis then the package can be upgraded at any time.

  11. Non-Refundable Fees. All domain name registration fees and web hosting fees are non-refundable.
